Advertising Terms and Conditions

The terms and conditions listed here apply to all advertisers who advertise on NYJSM.com a product of Bardini & Vasey, Inc and its subsidiary networks. Please review the following terms and conditions carefully before you register for the NYJSM.com advertising program. Upon submission of payment through PayPal services below or receipt of payment to Bardini and Vasey, Inc, 1802 S.MacDill Ave, Tampa, Florida for NYJSM.com advertising services automatically indicates that you understand and agree with all the terms and conditions listed here. There are no refunds of payment.

Participation and Purchasing of Advertising:
One must be at least 18 years of age to participate in this NYJSM.com advertising program.

Placement:
Billboards will be placed in both the horizontal leaderboard and vertical skyscraper position for the duration of payment period.

Start Date:
Submitted advertisement will be placed on NYJSM.com following receipt of digital file.  Advertising period will begin on the date of internet publishing and confirmatory email notification.

Rates:
The rates will be established by consultation with a certified representative of NYJSM.com. NYJSM.com will not post or display an advertisement until full payment has been received.

Advertisers Responsibilities:
It is the advertiser's responsibility to provide NYJSM.com with the design/banner of the advertisement with specific guidelines from NYJSM.com. NYJSM.com is not responsible for any queries from the readers with regards to the advertisement and it is not responsible for any error that occurs with regards to the transmission of data between the advertiser's site and NYJSM.com.

Payment:
Payment must be received before the placement of the Billboard advertisement. VERY IMPORTANT: Payment amount must be consistent with amount submitted by representative of your Billboard will NOT be displayed!  There are NO refunds.

Rejection and Cancellation of Advertisement:
NYJSM.com reserves all the right to refuse, cancel and reject any advertisement at anytime with or without notification to the advertiser at any time in its own discretion. NYJSM.com reserves the right to make changes at any time in its sole discretion to future rates, including but without limit, the advertising rates with or without notification.

Advertising Format:
Should the format of Billboard presentation change from its existing size and location.  The existing Billboard will be automatically adjusted to continue presentation for the designated duration.

Site Traffic History:
Collective traffic for all websites directed to NYJSM.com is in the hundreds of thousands since the concepts beginning in 2006.  Monthly page views are in the tens of thousands.

Statistics:
NYJSM.com does not guarantee anything with regards to future traffic or redirected traffic statistics in terms of number of viewers, uniques, hits, etc.  NYJSM.com makes no warranty on anything with regards to the advertisement and/or link posted on NYJSM.com.  You are investing in NYJSM.com as is.

Creation of Billboard:
By granting NYJSM.com permission to create a Billboard you are allowing information/images to be pulled off of your website to create a Billboard consistant with the face and theme of your website.  There is no review/editing for approval process for creation of a Billboard and attest you have the authority to permit use of content.  You are guaranteed the content will come from the specified URL and be linked appropriately to that website. Please preview existing advertisements and the linked webpages featured on NYJSM.com.

Responsibility:
NYJSM.com is not responsible, in any circumstances, for any legal liability with regards to the followings: 1) Advertisement, including but not limited to, layout, design, graphics and text. 2) Any information the advertiser provides to NYJSM.com, NYJSM.com is not responsible for its content. 3) Advertiser represents and warrants that the content of the advertiser's link do not violate any of the terms and conditions in this agreement, and including but not limited to the terms and conditions listed on NYJSM.com. 4) Advertisers represents and warrants that the use of the advertisement, including but not limited to reproduction, transmission and distribution do not violate any terms and conditions of this agreement and do not violate any laws or any rights of any third parties. 5) There is no explicit and or adult entertainment/pornographic content on the website being advertised. 6) Agree to monitor updates to future Terms and Conditions for both advertisement and NYJSM.com as there will be no notification of such. Advertisers hereby agree to indemnify NYJSM.com and to hold NYJSM.com free and harmless from and legal liabilities. NYJSM.com shall not be responsible, in any circumstances, any liability, including but not limited to legal fees and expenses.

Limitations on Liability:
NYJSM.com is not liable in any circumstance for any error with regards to displaying the advertisement. No refund will be granted for any error that occurs with regards to the displaying advertisement and error that occur in your own site. Under no circumstance is NYJSM.com liable for any damages.

Representations and Warranties:
You are the owner of the company/site or you are legally authorized to represent the company that you are advertising for with regards to this agreement between you and NYJSM.com.

Miscellaneous:
The relationship between NYJSM.com and you is not one of a legal partnership relationship, but is one of independent contractors.
